Howard County enforces the Maryland-adopted 2021 International Swimming Pool and Spa Code. Section 305.2 sets the outdoor residential barrier standard: a minimum 48-inch height on the side facing away from the pool and no more than 2 inches of vertical clearance at the bottom. Where horizontal members are less than 45 inches apart they must be on the pool side; where 45 inches or more apart, vertical member spacing may not exceed 4 inches. Barriers must be installed and inspected before the pool is filled and must meet Planning and Zoning setbacks.
An out-of-compliance or missing barrier is a code violation that can bring stop-work orders, fines, and failed inspections until the fence meets the 48-inch standard.
