Jackson County, GA Swimming Pools & Spas: Fencing & Safety Requirements (2026)

Sec. 3-122 of the Unified Development Code governs residential swimming pools in unincorporated Jackson County. Subsection (a) sets the pool's location: the water's edge must be at least 15 feet from any property line. Subsection (b) then requires that the pool be enclosed, either by a fence or a wall, standing at least four feet in height, with a gate that locks. The code does not distinguish between in-ground and above-ground pools or specify self-latching hardware beyond requiring that the gate lock, so any gate mechanism that secures the enclosure satisfies the letter of the rule.

The barrier requirement exists independently of the pool's own construction: a homeowner who builds a compliant pool but skips the fence, installs a fence shorter than four feet, or leaves the gate unlocked or unlockable has not met Sec. 3-122(b). Subsection (c) layers on additional approvals, requiring that pools also meet all other applicable county ordinances and receive sign-off from both the Jackson County Environmental Health Department and the Building Inspector before use. Because the UDC treats the fence, the setback, and the health and building approvals as separate, cumulative requirements, a pool that satisfies the four-foot enclosure standard can still be out of compliance if the underlying inspections were never completed.
