Unincorporated Jackson County adopts the 2018 International Residential Code (IRC) and 2018 International Building Code (IBC) under Jackson County Code Chapter 54 (Building Code), enforced by the Public Works building inspection staff. Pool barrier rules follow IRC Appendix G / IBC Section 3109 standards: a minimum 48-inch-high enclosure surrounding any pool deeper than 24 inches, with self-closing/self-latching gates that swing outward and have latches at least 54 inches above the ground (or below 54 inches with the latch on the pool side and an opening no greater than 1/2 inch within 18 inches of the latch). A building permit is required for any in-ground or above-ground pool. Inside Kansas City, Independence, Lee's Summit, and other incorporated cities, each municipal building code applies.
Jackson County Code Chapter 54 (Building Code) adopts the 2018 International Building Code, 2018 International Residential Code, 2018 International Plumbing Code, 2018 International Mechanical Code, and 2017 National Electrical Code (with amendments) for unincorporated portions of the county. The 2018 IRC includes pool/spa barrier requirements through Appendix G and through reference to the International Swimming Pool and Spa Code (ISPSC). Required minimum standards: enclosure barrier minimum 48 inches measured on the outside of the barrier; openings in the barrier must not allow passage of a 4-inch sphere; clear spacing between vertical members not greater than 1.75 inches when the barrier has horizontal members spaced less than 45 inches apart; pedestrian gates must open outward away from the pool, be self-closing and self-latching, and have the release mechanism either on the pool side at least 3 inches below the gate top with no opening greater than 1/2 inch within 18 inches of the release, or located at least 54 inches above the ground; dwelling walls used as part of the barrier require door alarms or a powered safety cover meeting ASTM F1346. A building permit is required for any pool capable of holding water more than 24 inches deep and for any associated electrical work. Pool electrical bonding and grounding follow the 2017 NEC, Article 680. Inside cities β including Kansas City (Chapter 18, Building and Construction Regulations) and Independence (its own adopted IBC/IRC) β the city's building department issues permits and enforces local pool barrier rules, which generally mirror or exceed IRC Appendix G.
Construction of a pool or pool barrier in violation of Chapter 54 (2018 IBC/IRC) is enforceable by Jackson County Public Works through stop-work orders, denial of certificate of occupancy, and civil action; non-compliant barriers can be ordered corrected and pools drained until brought into compliance. Liability for drowning incidents on non-compliant pools is exposed to civil claims under Missouri premises liability law. Inside cities, each municipal building code is enforced by the city building department with separate fine schedules.
