Applies to all pools over 24 inches deep including hot tubs without approved covers.
Barriers may be fences, walls, or a combination. Chain-link mesh cannot exceed 1.25 inches unless slatted. Gates must swing outward and have latch on pool side. House walls may serve as part of barrier if doors leading to pool have alarms or automatic closers meeting ASTM F2090. Above-ground pools with 48 inch walls and removable ladders satisfy barrier requirement when ladder is removed. Final barrier inspection required before pool use.
Non-compliant barrier: 250 dollars per violation, pool must be drained or secured until corrected. Drowning incident due to deficient barrier creates major civil liability and possible criminal charges (ORC 2903.05 negligent homicide).
