Pools 24 inches or deeper and 150+ square feet must have a barrier at least 4 feet high. Fence bottoms must be within 4 inches of the ground, openings no more than 4 inches, made of non-corrosive, not-easily-climbable material. All gates must be self-closing and self-latching at a height inaccessible to small children.
Under Section 11-21-5.G of the Lakeville City Code, fences are required for swimming pools with a depth of 24 inches or greater and an area of 150 square feet or more. All pools for which a permit is required and granted must be provided with a physical barrier to prevent children from gaining uncontrolled access; this can be accomplished with fencing or the walls of a principal or accessory structure of sufficient density as to be impenetrable. The fence or wall must be at least four feet (4') in height. The bottoms of the fences must not be more than four inches (4") from the ground, and no open space in the fence may be more than four inches (4"). Fences must be of a noncorrosive material and constructed so as to be not easily climbable. All fence openings or points of entry into the pool enclosure must be equipped with gates or doors, and all gates or doors must be equipped with self-closing and self-latching devices placed at a sufficient height so as to be inaccessible to all small children. A separate zoning permit is required for the pool fence. Prior to filling the pool, the approved physical barrier must be completely in place and inspected and approved by the city building official.
Filling a pool before the barrier is in place and inspected, gates that are not self-closing/self-latching, gaps over 4 inches, fences under 4 feet, or easily climbable materials are code violations subject to correction orders. The city building official must inspect and approve the barrier before the pool is filled.
