Tuolumne County's Building Division requires a pool barrier at least 60 inches tall measured from the outside. Maximum ground clearance under the barrier is 2 inches (4 inches over a solid surface). Openings must not pass a 1-3/4 inch sphere. These rules implement the California pool barrier code.
Per the Tuolumne County Residential Swimming Pool Enclosure handout, the top of the barrier must be at least 60 inches above grade, measured on the side facing away from the pool. The maximum vertical clearance between grade and the bottom of the barrier is 2 inches, increasing to 4 inches when grade is a solid surface such as a concrete deck, or when the barrier is mounted atop an above-ground pool structure. Openings in the barrier must not allow passage of a 1-3/4 inch-diameter sphere. Where horizontal members are spaced less than 45 inches apart, they must be placed on the poolside; decorative work that makes the barrier easily climbable is prohibited. Chain-link fences must be no less than 11 gauge. Access gates must meet the same standards and be self-closing and self-latching; where the latch release is below 54 inches, it must be on the pool side at least 3 inches below the top, with no opening over 1/2 inch within 18 inches of the release. Pedestrian gates must swing away from the pool, and non-pedestrian gates must stay locked. These provisions track the California Building Standards Code and the state Swimming Pool Safety Act (Health & Safety Code 115920 et seq., including 115922 and 115928).
A pool without a compliant barrier cannot pass inspection and may not be filled. Code Compliance can cite a non-conforming or missing barrier as a violation; owners are responsible for maintaining enclosures, gates, and alarms in working order.
