A hot tub with a lockable cover does not need a fence. Note that Maple Grove's separate residential fence rules (Sec. 36-816) generally cap residential fences at six feet, so a pool enclosure fits within those limits. Fence design and gate details must be shown on the pool permit plans.
An unfenced pool capable of holding water, or a gate that is not self-closing and self-latching, is a code violation that the building department may order corrected before the pool is used; the owner or contractor bears responsibility for compliance.
