Under Midwest City Code Chapter 39, pools are an accessory use and the yard containing the pool must be completely enclosed by a permanent wall or fence at least 48 inches in height. A swimming pool permit must be obtained from the Development Services Department before installation or alteration; this applies to all in-ground pools regardless of size and to above-ground pools larger than 12 feet in diameter or any pool served by a permanent pump or filter (Ch. 39 Β§ 39-5). Statewide, the 2015 IRC Appendix AG105 (adopted by the OUBCC under 59 O.S. Β§ 1000.21) governs technical barrier specs: openings cannot allow passage of a 4-inch sphere, the bottom of the barrier may be no more than 2 inches above grade, and pedestrian gates must open outward from the pool, be self-closing and self-latching, with the release mechanism at least 54 inches above the ground.
Installing or altering a pool without a Development Services permit violates Chapter 39 Β§ 39-5 and triggers stop-work orders. An unfenced or non-compliant enclosure is a code violation subject to abatement and citation, plus significant premises-liability exposure in drowning cases.
