R326.2 Enclosure. Swimming pools shall be completely enclosed by a fence or barrier not less than 4 feet (1219 mm) in height or a screen enclosure. Openings in the fence or barrier shall not permit the passage of a 4-inch-diameter (102 mm) sphere.
Exception: A swimming pool with a power safety cover or a spa with a safety cover complying with ASTM F1346 need not comply with this section.
(Ord. No. 3988, § 3, 3-25-2024).
Editor's note— Ord. No. 3961, § 3, adopted March 25, 2024, set out new provisions intended for use as § 16.06.530. To avoid the duplication of section numbers and at the editor's discretion, these provisions have been included as 16.06.535.
Official source re-checked September 7, 2026: no newer edition of the code had been published (publisher’s edition: Code of Ordinances: Supplement 39).
Full Breakdown
Section 16.06.535 rewrites IRC § R326.2 for Edmond: pools must be completely enclosed by a fence, barrier, or screen enclosure at least 4 feet tall, and any opening in that barrier can't pass a 4-inch-diameter sphere, the standard test for gaps large enough for a toddler to squeeze through. A pool with a power safety cover, or a spa with an ASTM F1346-compliant safety cover, is exempt from the fence requirement entirely. The rule was last amended by Ordinance 3988 in March 2024.
Violations & Fines
Pools built or altered without a compliant fence fail building inspection; Edmond's Building Inspection Division can withhold final approval and the certificate of occupancy until the barrier meets the 4-foot/4-inch standard.
