320 defines a private swimming pool as any structure for swimming, recreational bathing, or wading that is not inside a completely enclosed building and can hold water more than 24 inches deep at any point, expressly covering in-ground, above-ground and on-ground pools, hot tubs, spas, and fixed-in-place wading pools. 3 requires the pool area to be walled or fenced so as to prevent uncontrolled access by children from the street or from adjacent properties, or alternatively equipped with an ASTM International tested lockable cover; the fence or wall must be not less than 4 feet in height and kept in good condition.
