Rio Rancho's fence/wall regulations in Section 154.77 of the zoning code set the pool-barrier standard. Subsection (F)(1) requires fences around any swimming pool that is greater than three feet in depth or that exceeds 5,000 gallons. The pool must be enclosed on all sides by a fence or other barrier that provides an impediment of at least six feet, thereby limiting access. The code separately defines a SWIMMING POOL FENCE as 'a fence that is six feet in height that serves to limit access for safety purposes.' Where there is a grade separation or an above-ground pool, the six-foot minimum height is measured from outside the fence while the pool is on the inside. Gates on pool fences are required to be six feet in height with a self-closing latch at least four and one-half feet (54 inches) off the ground. The code provides one alternative: in the case where a common fence cannot be used as the swimming pool fence, the swimming pool fence must be a minimum of four feet in height with a hard cover that complies with the International Building Code. All fences also require a zoning plan review, and the barrier must be shown on the site plan submitted with the pool permit. The ordinance is cited as Ord. 18-20.
An unfenced or noncompliant pool barrier is a code violation. Fences declared a nuisance or hazard by Development Services or the Traffic Safety Advisory Committee may be required to conform or be removed within 30 days. Pool permits will not pass plan review without a compliant barrier on the site plan.
