The PA UCC adoption of IRC Chapter 42 Appendix G and IBC 3109.4 requires a 48-inch barrier with no opening that passes a 4-inch sphere, gates that open outward and are self-closing and self-latching, latch release at least 54 inches above grade for indoor latches, and horizontal-member spacing rules. Fences must be continually maintained and replaced when damaged, with failure to replace cited as a Chapter 445 violation. Hot tubs with an ASTM F1346 lockable cover are exempt from the fence requirement.
An outdoor pool without an enclosing fence at least 4 feet high, openings wider than 2 inches, or a gate missing a self-catching latch is a city code violation. Code Enforcement can order the pool drained, issue daily fines under Chapter 445, and trigger attractive-nuisance civil liability.
