Unincorporated Placer County enforces the California Swimming Pool Safety Act (Health & Safety Code Β§Β§115920-115929) and CBC Β§3109. Pools deeper than 18 inches require an enclosure at least 60 inches high with self-closing, self-latching gates with latches at 60+ inches. New or remodeled pools must have at least two of seven approved drowning prevention features.
California state law preempts local pool barrier rules and applies countywide, including in Tahoe-area communities. Per HSC Β§115923, a permanent pool enclosure must be at least 60 inches high, with no more than 2 inches of vertical clearance between the bottom of the barrier and ground, and any gaps must not pass a 4-inch sphere. Latches must sit at least 60 inches above ground, and the outside surface must be free of handholds. Per HSC Β§115922, when a building permit is issued for a new pool, spa, or pool remodel, the pool must include at least two of seven approved drowning prevention features: (1) a compliant enclosure, (2) removable mesh fencing meeting ASTM F2286, (3) an ASTM F1346 safety cover, (4) exit alarms on house doors providing direct pool access, (5) self-closing/self-latching devices on doors with release at least 54 inches above the floor, (6) a pool alarm meeting ASTM F2208, or (7) other equivalent protection. Building permits for pools are issued through Placer County Building Services, which adopts the California Building Code including CBC Β§3109.
Construction without a permit or non-compliant barriers requires corrective work before final inspection. Unsafe pools may also be enforced as a public nuisance by Placer County Environmental Health, with stop-work orders and abatement.
