Health and Safety Code Section 115923 spells out five mandatory characteristics for any pool enclosure: access gates must open away from the pool and be self-closing with a self-latching device no lower than 60 inches above the ground; the enclosure must stand at least 60 inches high; the maximum vertical clearance from the ground to the bottom of the barrier is two inches; gaps or voids cannot pass a sphere four inches or larger in diameter; and the outside surface must be free of protrusions, cavities, or other features that could let a child under five climb over.

Section 115921 defines "swimming pool" to include any structure for swimming or recreational bathing holding water over 18 inches deep, in-ground or aboveground, including hot tubs, spas, portable spas, and nonportable wading pools, and defines "enclosure" as a fence, wall, or other barrier that isolates the pool from access to the home. 2 to require that whichever two of the seven features are chosen, at least one must be an enclosure meeting Section 115923's specifications and isolating the pool from the home. Section 115925 exempts public swimming pools, hot tubs or spas with locking safety covers meeting the ASTM F1346 standard, and pools at apartment complexes or other non-single-family residential settings.
