Bellingham, WA Swimming Pools & Spas: Pool Permits (2026)

BMC Chapter 17.10 (Building Codes) adopts the Washington State Building Code, including the 2021 IBC under WAC 51-50, the 2021 IRC under WAC 51-51, and the 2021 International Swimming Pool and Spa Code under WAC 51-50, effective March 15, 2024 per the City of Bellingham Construction Codes page. BMC 17.10.020 (Construction Administrative Code) carries the IRC R105.2 / IBC 105.2 permit exemption for 'prefabricated swimming pools accessory to a Group R-3 occupancy [or 1- and 2-family dwelling] that are less than 24 inches (610 mm) deep, do not exceed 5,000 gallons (18 925 L), and are installed entirely above ground.' Pools, hot tubs, and spas that exceed any of those thresholds require a building permit. ISPSC 2021 Section 305 (Barrier Requirements) applies, including the 48-inch minimum barrier height, 4-inch sphere rule, 2-inch grade clearance (4 inches on solid surface), and self-closing/self-latching/outward-opening pedestrian gates. Residential electrical permits for pool circuits, NEC Article 680 bonding, and equipment are administered by Washington State L&I under WAC 296-46B; the State L&I inspector verifies bonding and grounding. Decks supporting hot tubs and spas must meet the load provisions of the 2021 IRC (WAC 51-51); engineered design may be required. Under RCW 19.27 (State Building Code Act), Bellingham applies the State Building Code Council's standards as written.
