California SB 793 upheld by Proposition 31 bans the sale of all flavored tobacco products in Anaheim including menthol cigarettes, flavored cigars, flavored vape cartridges, and flavored chew, with limited exemptions for premium cigars, loose-leaf tobacco, and shisha.
Effective December 21, 2022 after voters affirmed it through Proposition 31, California Health and Safety Code section 104559.5 prohibits any retailer in Anaheim from selling flavored tobacco products or tobacco product flavor enhancers. The ban covers menthol cigarettes, fruit and dessert vape cartridges, flavored small cigars and cigarillos, flavored smokeless tobacco, and flavor-added accessories. Hand-rolled premium cigars over a fixed price threshold, loose-leaf pipe tobacco, and shisha sold at licensed hookah lounges with limited entry are narrowly exempt. Anaheim follows state enforcement through the California Department of Tax and Fee Administration and OC HCA.
Selling flavored tobacco is a misdemeanor with fines up to $250 per violation and risks suspension or revocation of the retailer's California Cigarette and Tobacco License after repeat offenses.
