Summary

Hesperia bans retailers from selling any flavored tobacco product, including flavored e-cigarettes and menthol cigarettes, with narrow exceptions for premium cigars and loose-leaf pipe tobacco.

It shall be unlawful for any tobacco retailer to sell any flavored tobacco product, including flavored e-cigarettes and menthol cigarettes, as well as tobacco product flavor enhancers. This does not apply to flavored premium cigars with a wholesale price of twelve dollars ($12.00) or more and flavored loose-leaf pipe tobacco. Flavored shisha/hookah tobacco may only be sold in licensed stores that only allow people twenty-one (21) or older on the premises at any time.

Full Breakdown

Under HMC § 5.80.020(D), no licensed tobacco retailer in Hesperia may sell a flavored tobacco product, defined as any product with a distinguishable taste or aroma other than tobacco, covering menthol cigarettes, flavored e-cigarettes and vape liquid, and tobacco product flavor enhancers. The ban exempts flavored premium cigars priced at $12 or more wholesale and flavored loose-leaf pipe tobacco. Flavored shisha/hookah tobacco may still be sold, but only inside licensed shops that restrict entry to customers age 21 and older at all times.

Violations & Fines

Selling a banned flavored product violates the tobacco retailer's license terms and can trigger license suspension, revocation, or denial of renewal under Chapter 5.80's enforcement provisions.

Frequently Asked Questions

Are flavored cigars completely banned?
No: premium handmade cigars wholesaling at $12 or more, and flavored loose-leaf pipe tobacco, are exempt from the flavor ban.
