Worcester, MA Tobacco & Vaping: Flavored Tobacco Bans (2026)

Chapter 8, Section 3 of the Revised Ordinances is Worcester's Tobacco Products Control Ordinance, adopted to curb youth access to tobacco and nicotine products. The city council's findings single out blunt wraps and flavored nicotine delivery products by name: finding (16) notes that nicotine solutions used in electronic cigarettes are "sold in dozens of flavors that appeal to youth, such as cotton candy and bubble gum," and finding (12) flags blunt wraps as products "frequently marketed and sold to the youth" that also double as drug paraphernalia.

Rather than regulate flavors product-by-product, the ordinance's Sale and Distribution provisions, Section 3(h), impose a flat ban: subsection (h)(9) states "No retail establishment or entity shall sell or cause to be sold blunt wraps," full stop, with no exception for unflavored variants. " Every retailer selling any tobacco product must also hold an annual permit from the Board of Health, obtained only after the retailer certifies compliance with this ordinance. The Director of Public Health and the Commissioner of Inspectional Services, among other city officers named in Section 1, enforce these provisions.
