(A) It shall be the duty of every occupant of any premises containing a single-family dwelling, and it shall be the duty of every owner or person in control of any premises containing two or more dwellings or an unoccupied or vacant single-family dwelling to: (1) Place or cause to be placed, before 7:00 a.m. on the day scheduled by the Director of Public Works for the collection of waste from the premises, every vessel or container containing waste materials in a readily accessible location to waste collectors at a point nearest either the street curbline or the traveled surface of the alley, or at such other location as designated by the Director of Public Works, as provided in Division (D) of this section. (2) Remove every vessel or container from the street curbline or the alley or the required front yard, as defined in § 150.03821, no later than 8:00 a.m. on the day after the scheduled date of collection. (B) No vessel, container, or bulk items shall be placed for collection before 3:00 p.m. the day before the scheduled waste collection pickup.

Section 51.06 of the Dayton Revised Code of General Ordinances gives trash containers a fixed daily window. The earliest a vessel, container or bulk item can go out is 3:00 p.m. on the day before the scheduled waste collection pickup. The latest it can be in place is 7:00 a.m. on the collection day the Director of Public Works has scheduled for that address. After pickup, every container must be removed from the street curbline, the alley or the required front yard no later than 8:00 a.m. on the day after the scheduled collection date. The required front yard is defined in § 150.03821, so a bin left in that yard past the deadline is a problem even when it sits off the pavement.
The duty lands on different people depending on the property. For a single-family dwelling, the occupant carries it. For premises with two or more dwellings, or an unoccupied or vacant single-family dwelling, the owner or person in control of the premises carries it. A landlord with a duplex or an apartment building answers for container placement, and so does the owner of a vacant house.
Location matters as much as timing. Containers go in a readily accessible location to waste collectors at the point nearest either the street curbline or the traveled surface of the alley. Under division (D), when the premises are not accessible to a street or alley, or placing the containers involves special difficulties, the Director of Public Works or his agents can designate the place. The Director also arranges the collection schedule under § 51.05 and writes the collection rules under § 51.04.
Division (C) adds a storage rule: containers cannot be stored where they could become offensive or constitute a nuisance to occupants of adjacent properties. Section 51.02 backs it up. Containers must be kept clean, dilapidated, dirty or oversized containers are not permitted, and after written notice they are seized and destroyed. Only containers provided by the city, or specifically approved by the Director of the Department of Public Works, are eligible for city collection.

Violating any provision of Chapter 51, including § 51.06, is a minor misdemeanor under § 51.99. An offender with a prior conviction under the chapter faces a fourth degree misdemeanor for the next violation. Inspectors in the Division of Neighborhood Development can issue a citation tag under § 51.11. The tag lets the defendant appear at the Clerk of Court's office, sign a guilty plea and waiver of trial, and pay a stated fine and costs instead of appearing in court. A defendant who fails to appear can be the subject of an arrest warrant.
