Gary, IN Trash & Recycling: Bin Placement Rules (2026)

Section 34-53 of the Gary Municipal Code, part of Chapter 34's collection and disposal article, controls where residents and businesses may keep their garbage, rubbish and ash containers between pickups. The default rule is that containers cannot be stored on public property, and cannot be placed so that they create a nuisance for neighboring residents. The only time a container may sit on public property is for collection itself, and even then only where the complete private lot is occupied by structures, leaving no room to stage the container on private ground.

Containers set out for pickup must be placed convenient to the alley or street, following whatever specification the street commissioner sets for that route, and the container's owner is responsible if the container causes property damage while sitting on public property. Any rubbish collected by a private hauler, rather than the city, must be stored inside the building where it was produced until the hauler arrives, not left outdoors. Section 34-52(b) adds construction standards that go with placement: containers for garbage and rubbish must be watertight metal or equivalent, strong, rodentproof, fitted with flytight covers, kept covered except when adding to or emptying them, and capped at 20 gallons in capacity, with washing and disinfecting required often enough to prevent odor.

A portable container that does not meet these standards can be classified as rubbish itself and hauled away as such after five days' written notice to the owner, under § 34-52(d). Enforcement runs through general services and the board of health, and Chapter 34 violations carry the Code's general penalty, § 1-7: up to $2,500.00 for a first offense and up to $7,500.00 for repeat offenses.
