Full Breakdown

Cart placement is set by § 165-12 of the Lower Paxton Township Code, part of the Municipal Solid Waste and Recycling Ordinance. Each municipal waste container and curbside recyclable container must be placed for collection so the collector can reach it at ground level and behind the curb, if one is provided. Containers cannot be placed in the roadway where they would impede or delay the removal of snow or ice from the road. Where there is no curbing, proper cart placement in line with the current hauler requirements is required within no more than 10 feet of the cartway of the street or alley from which the collection vehicle works, or at a location mutually agreeable between the resident, the Township and the collector. If a cart is not placed at such a location, the waste can go unpicked.

Timing has three parts. Carts are not permitted to be stored at the collection location outside the scheduled pick-up days. Waste and recycling containers must be placed at the collection site of a residence prior to 6:00 a.m. on the scheduled collection day, and they can be placed at curbside up to eight hours before that day. After pickup, containers must be removed from the right-of-way within eight hours after the scheduled collection day. The Township can extend this time at its discretion, and the same limits apply to the keeping or storing of compost bags.

Commercial and institutional properties follow a different standard. Their containers go on the owner's or occupant's premises at a place agreed upon with the authorized collector and satisfactory to the Township, and the location cannot interfere with public or private sidewalks, walkways, driveways, roads, streets, highways, alleys, or entrances and exits of public or private buildings. Large containers must also comply with Zoning Ordinance 203-806, Dumpsters and Screening. Separately, § 203-521 allows dumpsters only in side or rear yards, bars them from required parking spaces, requires screening from adjoining roads and properties on a minimum of three of the four sides, and keeps them a minimum of 20 feet from an abutting dwelling.

Violations & Fines

A conviction under § 165-15 before a Magisterial District Justice carries a fine of not more than $1,000 plus costs and, in default of payment, a term of imprisonment not to exceed 90 days. Each day a violation continues is a separate offense. The Township can also require an owner or occupant to remove an accumulation of solid waste, and if it is not removed within five days after written notice, the Township can collect and dispose of it and charge the cost to the owner or occupant.
