In unincorporated Kane County, garbage may not be set out for collection more than 24 hours before pickup, containers must be flytight and vermin/rodent-proof, and garbage may not be left accessible to animals. Cities set their own curb placement rules.
Kane County Code Chapter 15 governs container placement outside city and village limits. It is unlawful to place garbage or trash out for collection more than 24 hours before the scheduled pickup time (§ 15-2(1)(f)), and household garbage may not be placed in an outside container so that it is accessible to animals. Garbage cans that are offensive and not flytight, vermin- and rodent-proof are declared nuisances (§ 15-2(1)(h)). Inside municipalities, the city or village — not the county — dictates where at the curb bins go and how soon after pickup they must be brought in.
Fine up to $500 per day for early set-out, animal-accessible garbage, or non-conforming containers in unincorporated areas.
