Rutherford County, NC Trash & Recycling: Bin Placement Rules (2026)

Section 15-24, Storage and disposal of solid waste generally, opens by barring anyone from depositing, storing or accumulating garbage or solid waste on their property except as the section allows. Subsection (1) sets the container standard: garbage "shall be stored in a container meeting the following requirements... durable, rust-resistant, nonabsorbent, water-tight, rodent-proof and easily cleanable, with a close-fitting, fly-tight cover in place, and with adequate handles or bails to facilitate handling," and containers "are not to exceed thirty-five (35) gallons' capacity when manually handled." The same subsection separately makes it "unlawful for any person to store garbage of a perishable or offensive nature for more than one (1) week in any type of container," regardless of whether the container itself meets the durability standard.

Subsection (2) adds a placement-neutral nuisance rule: waste cannot be stored so that it "provides food or harborage for rodents and vermin or creates a fire or safety hazard," which reaches open dumping in a yard as much as an unsecured lid. The section does not set a specific curb set-out time or window, or require screening from street view; its focus is the container's construction, its capacity, and how long perishable contents may sit before removal, leaving actual haul-away scheduling to whichever licensed collector or self-haul arrangement the resident uses under section 15-24(6).
