Summary
Los Angeles requires every commercial establishment and multi-family dwelling not already serviced by the City to subscribe to and pay for private hauler collection under LAMC § 66.03(c)-(d), with frequency set so nothing accumulates past the seven-day cap in § 66.03(a).
(c) Owners of Commercial Establishments and Multi-family Dwellings that do not receive Collection Services from the City, the generator of Solid Waste at such premises, or the agent of such owner or generator shall subscribe to and pay for Collection Services provided by a Solid Waste Hauler authorized to provide such services pursuant to the provisions of this article. (d) The minimum level of service to which the owner, generator, or agent of non-City-serviced Commercial Establishments and Multi-family Dwellings shall subscribe shall be the number and size of Solid Waste containers suitable for Solid Waste collection, and the frequency of collection necessary for the removal and disposal of all Solid Waste generated at the premises, excluding Commingled Recyclables and Source-Separated Recyclable Material, in a seven-day period. Such minimum level of service shall be determined by the owner, generator, or agent and the Solid Waste Hauler. In the event the owner, generator, or agent and the Solid Waste Hauler do not agree on the minimum level of necessary service, such determination shall be made by the Director.
Full Breakdown
03(c), owners, generators, or their agents at commercial establishments and multi-family dwellings that the City does not directly service must subscribe to and pay for Collection Services from a permitted Solid Waste Hauler, there is no opt-out into self-hauling for these properties absent a Bureau waiver process under a related subsection. 03(d) sets the minimum level of service: enough containers, in the right sizes, collected often enough to remove everything the premises generates within a seven-day period, excluding recyclables and organics that are picked up separately.
The property owner or agent and the hauler negotiate that minimum service level directly; if they cannot agree, the Director of the Bureau of Sanitation makes the call and that determination is binding. 1(a)(1) establishes the underlying policy: household solid waste is collected in one or more containers by a single pickup on a regularly scheduled basis, with additional pickups only when approved by Council resolution. 03(a): no person may keep solid waste on any premises for more than seven days (composting/mulch organics excepted), which is the functional floor that drives how often a schedule must run regardless of whether the City or a franchised private hauler is doing the picking up. The Bureau of Sanitation administers City-side service and enforces the private-hauler franchise system under the same article.
Violations & Fines
Failing to subscribe to required Collection Services, or letting solid waste sit on a property longer than the seven-day cap in § 66.03(a), is enforced by the Bureau of Sanitation under the article's inspection and enforcement sections (§§ 66.06-66.07), which authorize administrative citations and civil penalties against the owner, generator, or responsible agent. Unresolved disputes over minimum service levels are decided administratively by the Director rather than left to the parties indefinitely.
