City-specific rules exist: Sioux Falls has its own collection schedule rules that differ from Minnehaha County's county-level regulations. If you live in Sioux Falls, check the city-specific page instead.

Section 2.03. RESIDENTIAL RECYCLING COLLECTION AND WASTE DISPOSAL: All residential uses in the unincorporated portions of Minnehaha County shall have solid waste collection performed by a licensed commercial garbage hauler. Solid waste collection shall be performed a minimum of once per week. No residential solid waste or residential recyclables shall be burned in the county and the disposal of all solid waste shall be done at a solid waste facility properly permitted by Minnehaha County and the State of South Dakota.

Full Breakdown

03. The section, last amended November 13, 2007 by MC17-03-07, bars residents from burning household solid waste or recyclables anywhere in the county and requires that all collected waste go to a solid waste facility permitted by both Minnehaha County and the State of South Dakota. Waste bound for the Sioux Falls Regional Landfill must also comply with whatever landfill bans the City of Sioux Falls has in place, since the county's rural service area feeds that same regional site. Haulers themselves are not free to operate without oversight: Article 12 requires any commercial garbage hauler working the unincorporated county to hold a Minnehaha County commercial garbage hauler's license, applied for through the Planning Department with details on the business's location, zoning, and recycling services.

01 bars any solid waste management practice that spreads disease vectors, pollutes air, ground, or surface water, or otherwise harms the environment. 04, layers the identical weekly-collection and no-burn requirements onto commercial, business, and apartment properties, so mixed-use parcels in the unincorporated county face the same minimum service standard as single-family homes.

Violations & Fines

Article 11 makes any violation of MC17-91 a Class 2 misdemeanor punishable under SDCL 7-18A-2, with each day a property goes without required licensed collection or burns waste counted as a separate offense. The county can also pursue civil penalties under SDCL 34A-1, 34A-2, 34A-6, 34A-11, or 34A-12 on top of the criminal charge, and an unlicensed hauler risks losing its Minnehaha County garbage hauler's license entirely.

Frequently Asked Questions

Do unincorporated Minnehaha County residents have to use a licensed trash hauler?
Yes. Section 2.03 of MC17-91 requires every residential property in the unincorporated county to have solid waste collected by a licensed commercial garbage hauler, with pickup at least once a week, and residents cannot burn their household trash or recyclables instead.
How often must trash be picked up in unincorporated Minnehaha County?
At least once a week. Section 2.03 sets a weekly minimum for residential collection, and Section 2.04 applies the same weekly minimum to commercial, business, and apartment properties, so no unincorporated address can go longer than seven days between pickups under the ordinance.
What happens if a hauler collects trash without a county license?
Article 12 requires every commercial garbage hauler working the unincorporated county to hold a Minnehaha County commercial garbage hauler's license issued by the Planning Department. Operating without one, or violating the collection standards in Article 2, exposes the hauler to Class 2 misdemeanor penalties under Article 11.
