Full Breakdown

Article II of Chapter 348 of the Town of West New York Code governs household and business garbage. Under § 348-7(A), the owner, agent, lessee, tenant or occupant of every dwelling or other premises where refuse accumulates must provide sufficient and suitable receptacles with tight-fitting covers. Sufficient means at least one receptacle for each family unit or other occupant and at least two for each restaurant, market, store or similar business. Suitable means a watertight metal receptacle with a closely fitted cover, built to prevent spilling or leakage, of not more than 30 gallons. No garbage can be put out in bags, boxes or corrugated receptacles.

Timing is set by § 348-7(C): receptacles cannot be set out except during the hours of the day or days scheduled for collection, or the evening before, and not before 8:00 p.m. that evening. Section 348-8(G) keeps receptacles inside the building or in the rear or side premises until removal time, then at the sidewalk curb until emptied, after which they go back. Receptacles are filled no higher than a line four inches from the top, hold no more than 75 pounds, stay covered with a tight-fitting metal cover, and cannot sit within 10 feet of either side of a fire hydrant (§ 348-8(F), (G), (I)). Garbage must be drained of liquids and wrapped securely in paper (§ 348-8(A)).

Pickup by a private entity from any commercial enterprise must be completed on the scheduled day between 12:00 midnight and 7:00 a.m. (§ 348-7(E)). Collectors of refuse need a Department of Health license at $25 per year expiring December 31 (§ 348-9), and § 348-4 requires an annual license from the Board of Commissioners at $50 for each collection vehicle. The Code does not print weekday collection days for household garbage. For recyclables, the Recycling Coordinator sets days and sites under § 306-6.

Violations & Fines

Under § 348-10, storing, collecting or disposing of refuse in violation of § 348-7 or § 348-8 is declared a nuisance and detrimental to public health. Section 348-11 punishes violations as provided in Chapter 1, General Provisions, Article I. For recycling noncompliance, § 306-9 ends regular solid waste collection after the first three violations of § 306-2, until the time of compliance.
