Full Breakdown
9's Accessory Use/Structure Standards, AS-09 (Trash Refuse Standards) governs every dumpster and refuse area in unincorporated Clayton County, residential and commercial alike. The rule sets four concrete requirements: the pad under the dumpster must be cement, not gravel or dirt; the enclosure must sit behind the primary building, moving to the side only on corner or through lots where it can be kept out of view from the roadway; the structure must be screened opaquely on three sides using materials that match the building's exterior walls, not a bare chain-link cage; and it cannot be sited inside a required landscape strip, buffer, parking area, or loading area.
Two corridor-overlay sections point straight back to this standard: Sec. 21 (general Dumpster Standards) and Sec. 9. The Department of Community Development reviews dumpster and enclosure placement as part of site plan approval for any new commercial development, and the Zoning Administrator can require a developer to relocate or re-screen an enclosure that lands in a landscape buffer or loading area before a site plan is approved.
Violations & Fines
A site plan showing a dumpster pad in the wrong spot, without cement, or without three-sided screening will be rejected or held up at Department of Community Development review, and an already-built enclosure that violates AS-09 can be ordered corrected before a certificate of occupancy issues. Property owners disputing a screening or placement determination can pursue an administrative appeal or variance under Article 13's Variance Process (Sec. 13.21).
