Section 94.04(B) lists "right-of-way blockage" as item (12) among the encroachments the Designated Department can approve administratively rather than sending to the full Board of Public Works and Safety, and its subpart (a) names the specific triggers: "obstruction due to dumpster, construction equipment, construction materials, gravel, aggregate, mulch, unattached moving trailers, portable storage units, and tree removal or disposal equipment." Because dumpster placement falls under § 94.04(B) rather than the Board-approval list in § 94.04(A), the Designated Department reviews and can approve the permit directly unless it decides the circumstances are unusual enough to escalate to the Board.

Section 94.10(A) sets the base encroachment fee at $100 for a dumpster or right-of-way-blockage permit, the same rate that applies to most other administratively approved encroachments, before any add-on for extended duration or Central Business District parking use. If a dumpster or roll-off is obstructing the right-of-way without an approved permit, § 94.09 lets the Director of the Designated Department issue a stop work order without prior written notice when delay would threaten enforcement or public safety, and § 94.99(B) adds "an additional penalty fee of $250" enforced alongside that stop work order, on top of the general chapter penalty in § 94.99(A) of up to $2,500 for a first violation and $7,500 and costs for a second or later violation, with each day of unpermitted blockage counted as a separate offense.
