No dumpster or garbage container shall be placed or stored within the public way for purposes other than a scheduled collection unless authorized by the department of public works in accordance with Wilmington City Code Section 42-217. City Code Section 45-250 requires any multifamily building with five or more units, plus licensed businesses, clubs, hospitals and nursing homes, to provide dumpsters or approved waste containers for collection. Section 45-251 bars leaving a dumpster in the public right-of-way except from 6:00 p.m. the night before collection until 6:00 p.m. on collection day, unless the Department of Public Works authorizes otherwise, and requires fencing or planting that screens the container on at least three sides. Overfilled dumpsters and waste piled outside them are also prohibited.
