Chapel Hill, NC Trash & Recycling: Illegal Dumping (2026)

Section 8-4 of the Code of Ordinances makes it unlawful to place or deposit garbage, household refuse, yard waste, tin cans, bottles, barrels, boxes, pallets, rags, debris, or other waste materials in any street, right-of-way, alley, sidewalk, or other public place in Chapel Hill, except where the town has authorized and approved it. Section 8-3 backs that with a companion rule against letting refuse accumulate on private premises such as houses, stores, restaurants, or fraternity and sorority houses. Section 8-11 sets the enforcement mechanism for dumping violations: a first offense in a twelve-month period draws a written warning or a twenty-five-dollar civil penalty, a second draws seventy-five dollars, a third one hundred fifty dollars, and a fourth or later violation two hundred fifty dollars, capped at five hundred dollars total.

Each day a violation continues after the town issues a citation counts as an additional violation subject to further penalty. A person cited may appeal to the town manager or a designee within fifteen days, triggering an administrative hearing and a decision within fifteen days of that hearing. Unpaid penalties become collectible through a civil debt action if not paid within thirty days of the citation or the conclusion of any appeal, and the town may also seek injunctive relief or an abatement order under section 8-11(e).
