Section 12.05.003, in Article 5 of Chapter 12 (Offenses Against Property), states plainly: no person may throw, deposit, or scatter, or permit to be deposited or scattered, any waste or other material of any kind upon a sidewalk, alley, street, bridge, or public passageway, or upon private property. The prohibition reaches both public rights-of-way and private land, so dumping trash, construction debris, tires, or yard waste on a neighbor's lot is covered exactly the same as dumping it in the street or an alley behind a business.

Chapter 12's general penalty provision, Section 12.08.001 in Article 8 (Offenses and Penalties in General), sets the punishment for every offense in the chapter, including scattering rubbish: a fine of up to $500.00 and incarceration for a term not to exceed six months upon conviction. The chapter also extends liability beyond the person who physically dumps the material. Section 12.08.002 makes it an offense to attempt scattering rubbish, defined as taking a substantial step toward the violation with the purpose of committing it, even if the dumping is interrupted before it's completed. Section 12.08.003 separately criminalizes knowingly counseling, abetting, or aiding another person's dumping, so a property owner who directs or helps a hauler dump illegally faces the same exposure as the hauler. Section 12.08.004 extends liability to corporations and unincorporated associations whose agents, directors, or high managerial employees engage in, authorize, or knowingly tolerate the conduct within the scope of their duties, so a business cannot dodge a dumping charge by pointing to an employee or contractor acting on its behalf.

The text lists no permit process or exemption for Section 12.05.003; the only lawful way to get rid of waste on private or public land in the City is through the regular trash, recycling, and bulk-item collection programs rather than curbside or lot dumping.
