010 of the Manitou Springs Municipal Code, the definitions section of the nuisance chapter, declares two overlapping forms of illegal dumping to be a public nuisance. Subsection (E)(3) reaches accumulation or storage of garbage, junk, refuse, litter, rubbish or debris that injures or endangers comfort, repose, health or safety, is offensive to the senses, obstructs or endangers passage on a street, sidewalk, alley or right-of-way, depreciates neighboring property values, or simply sits for more than seven consecutive days, regardless of where it happens. Subsection (E)(4) separately targets the act of dumping, placing or accumulating garbage, junk, litter, refuse, rubbish or debris on private property, in any spring, stream or river, or on public property, carving out only the city's own maintenance and material storage facility, a pointed provision in a mineral-springs town where trash reaching a creek or one of the historic springs is a real concern.
