040 of the Sparks Municipal Code bars two separate acts. Subsection A makes it unlawful to deposit, or cause to be deposited, garbage, rubbish, waste matter or any other matter in a street, irrigation ditch, alley, gutter, highway, sidewalk, or any other public or private property within the city. Subsection B separately bars dumping garbage, rubbish or waste matter into someone else's waste container without that person's actual or implied consent, a provision aimed at neighbors or non-customers using another household's or business's contracted receptacle.

010, sweeps broadly: 'garbage' covers putrescible animal and vegetable waste plus food-contact containers and packaging, 'rubbish' covers nonputrescible solid waste such as ashes, paper, wood, glass and plastics, and mixing garbage with rubbish converts the whole pile into 'garbage' for enforcement purposes. 030 separately makes it unlawful to let garbage, rubbish or waste matter accumulate for more than twenty-four hours after the district health officer gives notice to remove it, or to bury garbage, rubbish, metals or tin containers anywhere in the city. Enforcement runs through the Washoe County district health officer rather than only the police.

08 a misdemeanor punishable by a fine of not more than five hundred dollars, imprisonment in the city jail for not more than one hundred twenty-five days, or both. The chief of police deputizes the district health officer and designated agents, giving them peace-officer authority to issue citations to the Sparks Municipal Court and to seek injunctive relief to abate ongoing dumping violations.
