Kane County, IL Trash & Recycling: Pickup Rules & Schedules (2026)

Kane County Code Sec. 15-2 declares a list of conditions unlawful nuisances anywhere in the county outside the corporate limits of a city or village, and subsection (A)(6), Household Garbage, targets two specific practices. First, it bans placing household garbage in an outside container where it is accessible to animals, aimed at the raccoon- and rat-attracting habit of loose bags in an open can. Second, and more specifically a pickup-timing rule, it makes it a nuisance and unlawful to place garbage or trash out for collection more than twenty four hours before the scheduled pickup time, so residents cannot drag bins to the curb days ahead of the truck.

The rule sits inside the broader Sec. 15-2(A) Exterior Property Areas nuisance list, which also separately caps yard-waste accumulation at seven days (subsection 9) and manure/rubbish accumulation with a farm exemption of 216 cubic feet per acre (subsection 7), so the county treats early or excessive setout as part of the same exterior-nuisance scheme as junk storage and dumping. Enforcement runs through Sec. 15-5: an authorized representative gives written notice describing the violation, the location, what must be done to fix it, and a deadline, before Kane County files an administrative-adjudication complaint under chapter 2, article IX if the resident does not comply in time.

If the resident still fails to abate the nuisance, the county can hire a private hauler to remove the material and bill the owner, occupant or tenant for the cost under Sec. 15-7, and unpaid cleanup bills become a lien against the property at the next tax roll.
