Summary
In Lafayette's service area, only LCG's authorized contractor or its own employees may collect solid waste, yard waste, white goods and recyclables; residents must otherwise follow the current LCG hauling contract for how waste is set out and disposed of.
Sec. 74-42. - Collection of solid waste, yard waste, white goods and recyclables without authority prohibited. It shall be unlawful for any person other than authorized agents, contractors or employees of LCG to collect, remove or dispose of solid waste, yard waste, white goods and recyclables in the service area; provided, however, that nothing contained herein shall prevent the use of solid waste disposal devices as provided in the plumbing code. Nothing in this section shall prevent a resident from hiring a third party contractor to remove solid waste, yard waste, white goods and recyclables not being collected pursuant to an LCG contract, as long as the resident is already signed up and paying for weekly solid waste, yard waste, white goods and recyclables collection and disposal service as provided for by the then-current LCG contract(s).
Official source re-checked September 7, 2026: no newer edition of the code had been published (publisher’s edition: Code of Ordinances: Supplement 65).
Full Breakdown
Sec. " The section carves out two narrow exceptions, it doesn't stop use of in-sink solid waste disposal devices permitted under the plumbing code, and a resident may hire a separate third-party hauler only for waste not covered by an LCG contract, and only if that resident is already signed up and paying for the regular weekly LCG-contracted service. This authorization rule pairs with Sec. 74-31, which requires every owner and occupant to follow "the then-current LCG contract(s) for the collection and disposal of solid waste, yard waste and bulky waste, including but not limited to the type of containers authorized thereby as well as the manner for setting-out and maintaining said containers," putting ultimate compliance responsibility on the property owner.
Read together, these sections mean the specific pickup rules, container types, set-out manner, what gets picked up, flow from whatever contract LCG currently has with its hauler, not a fixed municipal schedule, and no unauthorized company or individual may substitute for that contractor.
Violations & Fines
Collecting waste without LCG authorization violates Sec. 74-42 and is enforced under Chapter 74's general penalty scheme (Sec. 74-23(e)): a fine of up to $1,000.00 and/or imprisonment up to 30 days, with each day of a continuing violation treated as a separate offense, plus possible civil injunctive relief and cost recovery by LCG under Sec. 74-23(d).
