New York State mandates source-separated recycling under NY GML Β§120-aa, requiring every municipality to adopt a recycling law. Albany County Local Law No. 6 of 1990 (as amended) and City of Albany Code Chapter 313 require residents to separate recyclables β newspaper, cardboard, metal cans, glass bottles, and plastics #1 (PET) and #2 (HDPE). Plastics #3 through #7 are accepted in single-stream at many Albany County haulers but not required. Plastic bags and film are banned from curbside recycling (NY Plastic Bag Reduction Act prohibited at retail since 2020 under ECL Β§27-2801). Albany County's ANSWERS authority handles recycling processing. Large generators under the 2022 NY Food Donation & Food Scraps Recycling Law (ECL Β§27-2201) β businesses generating over 2 tons/week of food scraps within 25 miles of an organics recycler β must donate edible food and recycle scraps. City of Albany offers food scrap drop-off at the Capital Roots Empire State Plaza farmers market and other sites.
Contaminated bin skipped with warning tag. Repeat contamination: $50 to $250 under Albany Code Β§313-44. Commercial non-compliance with GML Β§120-aa: $500+ per NYSDEC. Food scrap law violations for large generators: ECL Β§27-2211 penalties.
