On October 5, 2021 the El Monte City Council adopted Ordinance No. 3006 โ the Mandatory Organic Waste Disposal Reduction Ordinance โ codified at El Monte Municipal Code Chapter 8.21. The ordinance implements California Senate Bill 1383 (Lara, Chapter 395, Statutes of 2016), which sets a statewide goal of cutting organic waste in landfills 75% below the 2014 baseline by 2025. All residential, commercial, and multi-family premises must subscribe to City-provided collection of three streams: trash (brown), recyclables (blue), and organics/green waste (green). Acceptable organics in the green cart include lawn/garden debris, food scraps (fruit, vegetables, bones, coffee grounds, dairy, eggshells, fish, meat, grains, baked goods, spoiled food), and food-soiled paper such as pizza boxes and paper plates. Residents are issued a counter-top kitchen pail with compostable bags to separate food waste before transfer to the green cart. The material is processed by composting facilities and anaerobic digesters that convert it to renewable natural gas. Tier-1 and Tier-2 commercial edible-food generators are also required to donate surplus edible food to recovery organizations.
Per CalRecycle's SB 1383 regulations (14 CCR ยง18997.2) โ which Chapter 8.21 incorporates โ local jurisdictions must enforce against contamination and non-subscription. Following any required notice-and-cure period, administrative fines range from a minimum of $50โ$100 per violation per day for the first offense, $100โ$200/day for second offense, and $250โ$500/day for third or subsequent offenses against the responsible party (resident or business).
