Summary

Davidson County encourages, but doesn't mandate, separating recyclables from household trash, and it operates recycling through drop-off containers at county collection centers rather than curbside bins. Once glass, cans, plastic, cardboard, or newsprint is placed in a county drop-off container, it legally becomes county property under §50.06(D), and taking it back out is prohibited.

These county ordinances apply to unincorporated areas of Davidson County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(A) Each person who owns, leases, or manages a residence, residential unit, or place of business, industry, commerce, or other place providing goods or services, or institution, church, or school is encouraged to remove recyclable materials from the solid waste generated as outlined in division (B) below and make them available for recycling in division (C) below. Nothing in this chapter is intended to prevent any person from donating or selling recyclable materials to any other person. (D) (1) After recyclable material has been placed in a designated container at the drop-off collection center designated by the county or its authorized agent, the recyclable material shall become the property of the county or its authorized agent; and (2) No person, other than a county employee or the county's authorized agent acting in behalf of the county may remove recyclable material from a designated container that has been placed at a designated recycling location or collection center.

Full Breakdown

06(A) of the Davidson County Code of Ordinances encourages, without mandating, every person who owns, leases, or manages a residence, business, institution, church, or school to remove recyclable material from the solid waste stream and make it available for recycling; the section adds that nothing stops a resident from donating or selling recyclables to someone else instead of using the county's program. 06(B) requires it to be kept separate from other solid waste and prepared to specific standards: glass must be rinsed by color; metal cans other than aluminum must be rinsed, have both ends cut out, have the paper label removed, and be flattened, while aluminum cans need only be rinsed and flattened; plastic milk jugs and soft-drink bottles must be rinsed, caps removed, and flattened or crushed; corrugated cardboard (sandwich-type only, no pizza boxes, single-ply, or waxed boxes) must be flattened; and newsprint must be bundled, not tied, and kept dry and out of plastic bags.

06(C), prepared material goes into the designated recycling containers the county provides at drop-off centers, since Davidson County runs no curbside recycling bin program. 06(D) then fixes ownership: once recyclable material is placed in a county drop-off container, it becomes the property of the county or its authorized agent, and no one other than a county employee or authorized agent may remove material from a designated container at a collection center. 99 for violations such as scavenging a drop-off container.

Violations & Fines

Removing recyclable material from a county drop-off container, other than as a county employee or authorized agent, violates §50.06(D) and is enforced under §50.99's civil-penalty schedule: $75 for a first offense, $200 for a second, $300 for a third, and up to $500 for a flagrant violation, since dropped-off recyclables are legally county property.

Frequently Asked Questions

Is recycling mandatory in unincorporated Davidson County?
No. Section 50.06(A) only encourages residents, businesses, and institutions to separate recyclables from their trash; it doesn't require participation, and you're free to donate or sell recyclable material instead of using the county's drop-off program.
Where do I take my recyclables since there's no curbside bin?
Section 50.06(C) directs prepared recyclable material to the designated recycling containers the county provides at its drop-off collection centers. There's no curbside recycling cart program described in the county's general code.
Can I take recyclables back out of a drop-off container?
No. Once you place material in a county drop-off container, §50.06(D) makes it the property of the county or its authorized agent, and only a county employee or authorized agent may remove anything from that container.
How do I have to prepare cardboard for recycling?
Section 50.06(B)(5) requires corrugated, sandwich-type cardboard only, flattened before drop-off; pizza boxes, single-ply boxes, and waxed or treated boxes don't qualify and shouldn't go in the recycling container.
