Summary
Cincinnati's city-issued recycling carts stay city property, and only the city or its authorized agent may take what's inside. Municipal Code § 729-87 bars anyone else from removing curbside recyclables, forbids damaging or relocating a container assigned to another address, and makes clear that participation in recycling itself is not mandatory.
(a)Taking Recyclables. Recyclable materials placed on the curbside in a city recycling container or other container for recyclable materials will be collected by the city or its authorized agent. No person shall remove any recyclable materials or the container in which they are placed without the consent of the city manager except the owner or occupant of the dwelling or building to which the city recycling container is assigned.(b)Destruction of Container. Recycling containers provided to residents by the city remain the property of the city. No person shall intentionally deface, damage, or destroy any city recycling container.(c)Relocation of Container. Each city recycling container is assigned to a specific address. No person shall relocate a city recycling container to an address other than the one to which it is assigned. When a resident vacates the address, the resident shall leave the container at the assigned address.

Full Breakdown
Section 729-87 governs the city-issued recycling carts and bins Cincinnati assigns to addresses for curbside collection. Subsection (a) states that recyclables set out in a 'city recycling container or other container for recyclable materials will be collected by the city or its authorized agent' and bars anyone else from taking those materials or the container without the city manager's consent, the only exception is the owner or occupant of the dwelling the container is assigned to. Subsection (b) keeps ownership of every city-provided recycling container with the city itself and bans intentionally defacing, damaging, or destroying one.
Subsection (c) ties each container to a specific address: nobody may relocate it elsewhere, and a resident who moves out must leave the container behind rather than take it along. the day before collection, back off the curb before midnight on collection day. Subsection (e) is notable for what it doesn't require: nothing in § 729-87 mandates participation in the recycling program, and recyclables may legally be mixed with trash and set out for regular trash collection instead of being sorted into the recycling container.
Violations & Fines
Beyond the chapter's general § 729-99 Class A Civil Offense penalty, § 729-87(f) sets a specific consequence for container damage: anyone who 'damages, defaces, destroys, or relocates a city recycling container shall be liable to the city for an administrative penalty equal to the container's replacement value,' on top of any § 729-99 fine. Removing recyclables from another address's container without the city manager's consent is likewise a chargeable violation under subsection (a).
