Summary

Rural Josephine County treats recycling centers and resource recovery facilities as a regulated land use under Josephine County Code § 19.86.030. Operators must hold a County solid waste or recycling franchise license, keep storage and building setbacks at least 30 feet from property lines, and confine all collected and processed materials to the site.

These county ordinances apply to unincorporated areas of Josephine County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Full Breakdown

86 of the Rural Land Development Code covers the siting of solid waste operations, waste transfer centers, sewage transfer sites, resource recovery facilities and recycling centers together. 41; the chapter's review steps are the mandatory minimum and override any lesser procedure elsewhere in the title. 030(A), the operator must obtain and keep a County solid waste or recycling franchise license, or operate as an authorized subcontractor of a franchised operator, for as long as the use runs, and must obtain and keep every required federal, state and County permit; losing any of those permits is itself a violation of the development permit.

Storage and building areas for waste or recycling materials must sit back at least 30 feet from every property line, with a larger setback if needed to mitigate impacts, and the use cannot produce vibration, gas, dust, soot, smoke, steam, liquid or odor detectable from adjacent land. Near residential zoning, the operator must, where feasible, route delivery and pickup traffic and machinery maneuvering away from residential streets. Outdoor storage and processing must be screened by fencing, berms or vegetation. 030(C), must supply adequately sized containers to collect and store recyclables, keep all collected and processed material on site, and control littering on the property and along its perimeter.

Violations & Fines

Losing or failing to obtain a required federal, state or County permit is itself declared a violation under § 19.86.030(A)(2), subject to all enforcement remedies authorized by the title. On top of that, Title 19's general penalty at JCC § 19.19.010 makes any violation punishable, on conviction, by a fine up to $500 for a noncontinuing offense or up to $1,000 for a continuing one, after the Planning Director's required written-notice and correction period.

Frequently Asked Questions

Does a recycling operation need a license in Josephine County?
Yes. JCC § 19.86.030(A)(1) requires the owner or operator of a recycling center to obtain and maintain a solid waste or recycling franchise license from Josephine County, or to operate as an authorized subcontractor under another franchised recycling operator, for the entire time the use continues.
How far must a recycling facility sit from neighboring property?
Areas used to store waste or recycling materials, and buildings that house them, must be set back a minimum of 30 feet from all property lines under § 19.86.030(A)(3); the County can require a larger setback if it is needed to mitigate significant adverse impacts on neighbors.
What review does a new recycling center have to go through?
It needs Planning Commission review under Chapter 19.24, full site plan review under Chapter 19.42, and a development permit under Chapter 19.41; § 19.86.020 makes these the mandatory minimum procedures, overriding any lesser review the rest of Title 19 might otherwise allow.
