Marana Land Development Code Chapter 17-11 requires 100 percent preservation of crested saguaros and federally listed endangered species on development sites. At least 50 percent of all viable saguaros and ironwood trees must be preserved in place or transplanted on site.
Under Marana Land Development Code Section 17-11-5, crested saguaros receive the highest level of protection and must be preserved in place or salvaged and transplanted on site at a 100 percent rate during any development activity. Standard saguaros and ironwood trees carry a 50 percent preservation-in-place or transplant-on-site requirement. The saguaro cactus (Carnegiea gigantea) is also protected under Arizona Revised Statutes Title 3, Chapter 7 (Arizona Native Plant Law). Under ARS 3-904, landowners must notify the Arizona Department of Agriculture 20 to 60 days before destroying any protected native plants on parcels larger than 10 acres or where initial construction has not yet occurred. Under ARS 3-932, theft of protected plants valued at $1,500 or more is a Class 4 felony. Unauthorized collection without a permit is a Class 1 misdemeanor. Marana development projects must complete a site resource inventory (Section 17-11-3) documenting all protected native plants before grading permits are issued.
