In deciding a permit, the Director considers the tree's condition (disease, health, danger of falling), proximity to structures and utility interference, and the effect on erosion, soil retention, and surface-water flow. For LMAD trees, permission is required via a Tree Removal Request Application, and the district replaces removed trees with up to three 24-inch boxed trees under Policy E-3.
Removing a right-of-way tree, a regulated vacant-lot tree, or an LMAD tree without the required permit or permission violates Chapter 16.08. The city states it will pursue all appropriate legal remedies, which can include citations, replacement plantings, and cost recovery.
