Yorba Linda runs an annual Weed Abatement and Rubbish Removal program under California Government Code Chapter 13 (Section 39560 et seq.). Owners who receive a notice must clear combustible weeds, brush, dead vegetation, and debris to keep property fire-safe. Overgrown weeds are also a nuisance under YLMC 8.04.
Each year the city monitors properties and issues Weed Abatement and Rubbish Removal notices as authorized by California Government Code Chapter 13, Weed and Rubbish Abatement. Under Government Code Section 39560, 'weeds' include those bearing wingy or downy seeds, growing large enough to become a fire menace when dry, or otherwise noxious or dangerous. Noticed owners must abate all combustible vegetation, including dead leaves, weeds, brush, and tree limbs, plus excess trash and wood. The program's purpose is fire safety. Independently, the property-maintenance code treats dead, decayed, diseased, overgrown, or hazardous weeds that may harbor vermin, be unsightly, harm neighboring values, or create a fire hazard as a nuisance abated under Chapter 8.04.
If a noticed owner fails to abate weeds by the deadline, the city may abate the property and charge the cost back to the owner as an assessment or lien under the Government Code. Other weed nuisances use Chapter 8.04.
