(a) Water service pipe. ... (2) The owner, tenant or occupant of the property shall be continuously responsible for maintaining and keeping the water pipes leading to and between the plumbing system of his premises to the city's main water line in good repair and watertight so as to prevent the loss of water from the water system and to prevent the introduction of any stormwater, surface water, groundwater, roof runoff, subsurface drainage, uncontaminated cooling water or unpolluted industrial process waters to the water system. Failure to keep the water pipe leading from the plumbing system to the water main in good repair and watertight will give the city the right to cut off the water connection until the water pipe is repaired and watertight. ... (c) City reserves authority to work on water service lateral piping and sewer service lateral piping. In the best interests of the safety and health of the public, the city may clean, repair, maintain and/or bring into code compliance water service lateral piping or sewer service lateral piping, where these pipes are on city land or rights-of-way.

Full Breakdown

Section 32-27 of the Jacksonville Beach Code puts the leak duty on the person living at or holding the property, not on the city. The owner, tenant or occupant must maintain the water pipes that run from the premises' plumbing system to the city's main water line so they stay in good repair and watertight. The stated purpose is twofold: to prevent the loss of water from the water system, and to keep stormwater, surface water, groundwater, roof runoff, subsurface drainage, uncontaminated cooling water and unpolluted industrial process waters out of the water system.

The remedy the section names is shutoff: failure to keep the pipe watertight gives the city the right to cut off the water connection until the pipe is repaired and watertight. A separate paragraph covers obstructions, including tuberculation of the pipe, and says the connection is not reconnected until the pipe is cleaned and maintained properly. The sewer side has parallel duties in subsection (b). The city keeps its own authority too: where the lateral pipes are on city land or rights-of-way, the city may clean, repair, maintain or bring into code compliance the water service lateral piping or sewer service lateral piping.

The section does not print a deadline or a phone number for reporting a leak, so the practical trigger is the city's own notice and its shutoff right. Billing is handled in Section 32-28: no allowance is made for leaks on the consumer's side of the meter, but an adjustment can be made for usage above the normal monthly usage, set by the city from prior consumption history and adjusted to the rate in effect for zero (0) to four (4,000) gallons. A request must come with documentation of the leak in a format acceptable to the city. Section 32-29 lets authorized city employees with proper identification enter the premises at all reasonable hours to examine pipes or fixtures.

Violations & Fines

The penalty written into Section 32-27 is loss of service: the city can cut off the water connection when the water pipe is not kept in good repair and watertight, and it stays off until the pipe is repaired and watertight. Section 32-28 adds a billing consequence, because no volume is adjusted for leaks on the consumer's side of the meter except through the documented, city-decided adjustment for usage above normal monthly usage.

Frequently Asked Questions

Who has to fix a leaking water service pipe in Jacksonville Beach?
Under Section 32-27, the owner, tenant or occupant of the property is continuously responsible for keeping the water pipe between the plumbing system and the city's main water line in good repair and watertight. The section places that duty on the person at the property, with the city holding a shutoff right if the pipe is not kept watertight.
Can Jacksonville Beach shut off my water for a leak?
Yes. Section 32-27(a)(2) says failure to keep the water pipe in good repair and watertight gives the city the right to cut off the water connection until the water pipe is repaired and watertight. The same section applies a similar shutoff to obstructed pipes until they are cleaned and maintained properly.
Will I get a credit on my water bill for a leak?
Section 32-28 says no allowance is made for leaks on the consumer's side of the meter, with one exception. Excess usage above the normal monthly usage caused by a leak can be adjusted to the rate for zero (0) to four (4,000) gallons. The city decides the extent from prior consumption history, and you must submit documentation of the leak.
Who repairs pipes on city land or rights-of-way?
Section 32-27(c) reserves city authority over water service lateral piping and sewer service lateral piping on city land or rights-of-way. The city may clean, repair, maintain or bring those pipes into code compliance in the interest of public safety and health, even though the property occupant holds the general maintenance duty.
