Summary

Unincorporated Mason County lets a Master Development Plan applicant request extra dwelling units above base zoning density under MCC 17.70.015(b)(2)(C). Rural applicants can reach the density allowed for a performance subdivision, while urban growth area applicants earn one bonus unit per gross acre for every five percent of extra open space they set aside.

These county ordinances apply to unincorporated areas of Mason County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(C)Bonus Density. The county board of commissioners, or hearing examiner in the case of Belfair, may approve a bonus in the number of dwelling units allowed up to the maximum residential density allowed in the Mason County Code, based on the gross land area of the property, if:(i)For Rural Areas. The applicant may request a bonus in the number of dwelling units permitted by the underlying land use district, up to the density permitted by a performance subdivision in rural areas (see Mason County Code Section 17.03.032(a),Chapter 16.21,). Notwithstanding any other provision of Titles 16 and 17, the applicant may obtain such bonus density by means of approval of the MDP, and may subdivide consistently with such MDP by means of a standard subdivision, without approval of a performance subdivision.(ii)For Urban Areas. The applicant may request a density bonus of up to one unit/gross acre for each five percent increase in the total minimum required open space.

Full Breakdown

Mason County's density bonus for large-scale development is tied to its Master Development Plan (MDP) process, codified at MCC Chapter 17.70. An MDP is only available for a tract of at least ten acres inside an urban growth area, or two hundred fifty acres outside one, under MCC 17.70.011. Section 17.70.015(b)(2)(C) lets the Board of County Commissioners, or the hearing examiner for MDPs inside the Belfair urban growth area, approve a bonus above the number of dwelling units the underlying zoning district would otherwise allow, capped at the maximum residential density permitted anywhere in the Mason County Code.

In rural areas, an applicant can request a bonus up to the density that a performance subdivision would allow under MCC 17.03.032(a) and Chapter 16.21, and the county lets the applicant obtain that higher density through MDP approval alone, then subdivide by a standard subdivision rather than going through the separate performance subdivision process. Inside an urban growth area, the bonus is formulaic: one additional dwelling unit per gross acre for every five percent increase in the total minimum open space the project sets aside above what is otherwise required.

Before granting either bonus, the county must find that the project's design, through added privacy, open space, landscaping or amenities, offsets the impact of the added density, or that the higher density is compatible with existing uses nearby, and that no density is shifted from inside an urban growth area to land outside one. For parcels inside the Belfair mixed-use zone or the Allyn Village Commercial zone, MCC 17.70.012(2)(B) further requires the MDP to carry a residential density between three and fifteen units per acre.

Violations & Fines

There is no separate fine for seeking too large a density bonus; instead, Mason County Community Development and the Board of County Commissioners simply deny or condition an MDP application that cannot satisfy the findings in MCC 17.70.015(b)(2)(C) and 17.70.017, such as failing to show the added density is offset by design or is compatible with nearby uses. Building or occupying units beyond what an approved MDP authorizes is a code violation subject to Mason County Code § 1.04.010's general misdemeanor penalty of up to a $500 fine, 90 days in jail, or both.

Frequently Asked Questions

How much extra density can a Mason County project get through the MDP process?
Inside an urban growth area, MCC 17.70.015(b)(2)(C)(ii) grants one bonus dwelling unit per gross acre for each five percent of extra open space provided. In rural areas, the bonus can reach the density that a performance subdivision would allow under Chapter 16.21, still capped at the county's overall maximum residential density.
Who approves a Mason County density bonus request?
The Board of County Commissioners approves MDP density bonuses countywide, except within the Belfair urban growth area, where MCC 17.70.016(a) assigns MDP review, including the bonus density decision, to the county hearing examiner under a Type III permit process.
Can a Mason County density bonus move units from a rural area into town?
No. MCC 17.70.015(b)(2)(C)(iii)(c) and 17.70.012(2)(B) require that no density bonus transfer units from inside an urban growth area to land outside it, and the county must find the added density does not increase intensity outside the intended zone.
