Full Breakdown

F governs density above the caps set on the DPOD's Density Regulating Plan. " Four options exist. Bonus Option #1 grants 20 units/acre in the Core and Center sub-areas to properties whose front or street-side lot line directly abuts, or sits across a street from, a designated public open space. Bonus Option #2 grants 10 units/acre anywhere in the DPOD to properties within a quarter mile (1,320 feet) of the BCT North East Transit Center that dedicate at least 10% of required parking spaces to public parking, calculated to include the bonus units, and record a City lease for that public parking at a rate the City sets, for a term of not less than 50 years.

Bonus Option #3 grants 10 units/acre anywhere in the district for new nonresidential, multifamily, or mixed-use construction that funds public art equal to 1% of construction cost, either as a fee or as artwork of equivalent value, subject to Public Art Committee review and City Commission approval. 5802, Sustainable Development Options and Points. Separately, Density Areas inside the Transit Core Area boundary are exempt from any maximum units-per-acre cap altogether; their density is capped only by the building envelope set by maximum height, tower floorplate size, and building length.

Violations & Fines

Density bonus units are unlocked only through the Site Plan/Development Order review process under Article 2; a project cannot occupy bonus units without the recorded conditions (public parking lease, public art commitment, or sustainability score) being satisfied and verified by the Development Services Director. Stacking more than one bonus option on the same property is expressly barred by Section 155.3708.F.2. Failure to record the required 50-year public parking lease before using Options #2 voids that basis for the added units.

Frequently Asked Questions

Can a downtown property combine two density bonus options?
No. Section 155.3708.F.2 states a property may not utilize more than one density bonus option, unlike the height bonus table in the same district which allows stacking Option #2 with a second bonus.
What is the biggest density bonus available downtown?
Bonus Option #1 is the largest at 20 units per acre, available only in the Core and Center sub-areas to properties whose lot line directly abuts, or faces across a street, a designated public open space.
Does the transit center bonus require anything besides location?
Yes. Being within 1,320 feet of the BCT North East Transit Center only qualifies a property for Option #2 if it also reserves at least 10% of its parking for public use and records a 50-year public parking lease with the City.
