Summary
Before any site or building permit issues in Garland's Downtown District, a Downtown Development Plan must win Planning Director approval showing the project meets the district's design and use standards. Denials can be appealed to the City Council within 30 days.
(A) Prior to obtaining a Site or Building Permit, an approved Downtown Development Plan must be obtained from the Planning Director (or from the City Council, if the Director's decision is appealed) demonstrating that the proposal meets the goals, intent, and general standards contained in these district regulations. (B) A Downtown Development Plan application shall include the following information and documents that demonstrate compliance with the Downtown district: (1) Site layout plan (2) Proposed uses ... (E) Denial or conditional approval of a Downtown Development Plan by the Director may be appealed to the City Council using the same process as required for a Major Waiver. The appeal shall be filed in writing with the Director within thirty calendar days following the date of the Director's action on the Downtown Development Plan application.

28 governs every project inside the Downtown (DT) District. Subsection (A) makes an approved Downtown Development Plan a precondition to obtaining a Site or Building Permit, reviewed first by the Planning Director or, on appeal, the City Council. If the application also requests a Major Waiver, the Director schedules it for a Plan Commission hearing with a recommendation, and the Plan Commission forwards its own recommendation to the City Council, which holds a public hearing before approving, conditionally approving, or denying both the Plan and the waiver (F). 31.
Violations & Fines
No site or building permit will be issued in the Downtown District without a Director-approved Downtown Development Plan on file, so construction or occupancy sought without one simply cannot proceed to permitting. A Director's denial or conditional approval becomes final if the written appeal is not filed within 30 calendar days. An approved Plan that lapses under § 7.32 (extensions capped at two years under § 7.31) must be resubmitted and re-reviewed before permitting can resume, and any deviation beyond an approved Minor Waiver requires a full Major Waiver hearing before the Plan Commission and City Council.
