Summary

Turlock's zoning code bars the City from charging a separate utility connection fee or capacity charge for an ADU built entirely inside an existing home, mirroring the fee protections state ADU law requires statewide.

Utility connection required. All accessory dwelling units and junior accessory dwelling units shall connect to public utilities (or their equivalent), including water, electric, and sewer services. The City shall not require a separate utility connection between an accessory dwelling unit or junior accessory dwelling unit and the utility, or impose a related connection fee or capacity charge, for units located entirely within a primary dwelling, unless the accessory dwelling unit or junior accessory dwelling unit was constructed with a new single-family home.

(iii) No separate conveyance. An accessory dwelling unit or junior accessory dwelling unit may be rented. Except as provided in California Government Code Section 65852.26, no accessory dwelling unit or junior accessory dwelling unit may be sold or otherwise conveyed separately from the lot and the principal dwelling (in the case of a single-unit dwelling) or from the lot and all the dwellings (in the case of a multifamily dwelling).

(iv) Short-term lodging. Accessory dwelling units and junior accessory dwelling units shall not be rented for periods of thirty (30) days or less.

Full Breakdown

Turlock's accessory dwelling unit ordinance requires ADUs and JADUs to connect to public water, electric, and sewer service like any other unit, but it blocks the City from charging a second connection fee or capacity charge when the unit sits entirely inside the existing primary home. The waiver disappears if the ADU or JADU was built as part of a brand-new single-family home, since a new home already triggers standard utility hookup charges. The rule implements the ADU fee protections California's own ADU law (Gov. Code §§ 66310-66342) requires statewide; state law controls if a broader fee dispute arises.

Violations & Fines

The waiver only covers ADUs entirely inside the primary dwelling; if the ADU was built alongside a new single-family home, standard utility connection fees and capacity charges apply in full, and any billing dispute is enforceable under TMC § 1-2-01.

Frequently Asked Questions

Does Turlock charge a separate utility hookup fee for an ADU?
No: if the ADU is entirely within an existing home, the City can't charge a separate connection fee or capacity charge (TMC § 9-2-119(c)(13)(ii)).
Are there other California ADU fee protections?
Yes: state law (Gov. Code §§ 66310-66342) separately caps or waives development impact fees for small ADUs; Turlock's utility-fee waiver is a distinct, local rule.
