Summary
Folsom lets owners rent an ADU or JADU separately from the main house, but only on leases of 30 days or longer; short-term or vacation rentals of an ADU are barred. The ADU also cannot be occupied until the city has approved occupancy of the primary home.
A. Long-Term Rentals Only. An accessory dwelling unit and junior accessory dwelling unit may be rented separately from the primary residence; however, the rental shall be for a term of thirty days or longer. Occupancy of the accessory dwelling unit or junior accessory dwelling unit shall not be allowed until the city approves the occupancy of the primary dwelling unit. B. Sale or Conveyance. An accessory dwelling unit may be sold or conveyed separately from the primary dwelling unit to a qualified buyer, as defined in Government Code Section 66341, if all the requirements of Government Code Section 66341 are met.
Official source re-checked September 8, 2026: no newer edition of the code had been published (publisher’s edition: current through Ordinance 1369, passed April 28, 2026).
Full Breakdown
070(A) of the Folsom Municipal Code, "Rental and sale limitations," permits an accessory dwelling unit or junior accessory dwelling unit to be rented apart from the primary residence, but sets a floor of 30 days on the rental term, which forecloses nightly or weekly vacation-rental use of an ADU under this chapter. The same subsection ties occupancy timing to the primary home: an ADU or JADU cannot be occupied until the city has signed off on occupancy of the primary dwelling unit on the same parcel, so a detached ADU built ahead of or alongside a new main house cannot be rented out first.
070(B) separately allows an ADU to be sold or conveyed apart from the primary dwelling to a "qualified buyer" as defined in Government Code Section 66341, but only if every requirement of that state statute is met, which the chapter incorporates by reference rather than restating locally. 010(A) says implements California Government Code Title 7, Division 1, Chapter 13, and several other sections in the chapter state that the Government Code controls whenever it conflicts with Folsom's local text. The 30-day floor mirrors the standard state ADU statute limit on short-term rentals and applies to every ADU type described in the chapter (attached, detached, and junior), with no exception carved out for any zoning district.
Violations & Fines
Chapter 17.105 does not print a standalone fine schedule for renting an ADU short-term; enforcement runs through the city's general administrative violation process for zoning code breaches in Chapters 1.08 through 1.10, the same framework Chapter 17.104 cross-references for inclusionary housing violations elsewhere in Title 17, which allows administrative citations plus a misdemeanor charge carrying up to a $1,000 fine and up to six months in county jail for a knowing violation, with each day of a continuing violation charged separately.
