The City of Eagan amended its land use (zoning) code to allow an accessory dwelling unit as a permitted accessory use in the Estate and R-1 zoning districts. The ADU's total floor area must be no less than 300 square feet and no more than 960 square feet, or 33% of the primary residence's footprint, whichever is less. An ADU may contain no more than two bedrooms, and the total number of residents living in it cannot exceed two persons. No ADU is permitted if building coverage on the lot exceeds (or would exceed) 20%. Two off-street parking spaces are required for the ADU, in addition to the two off-street spaces required for the primary residence. The property owner must reside in either the primary residence or the ADU as their permanent, legal address, and the ADU cannot be subdivided or segregated in ownership from the primary residence. ADU registrations are filed with the City Clerk, last for a 12-month period, and must be renewed annually. Minnesota has no statewide ADU mandate, so these rules are entirely local.
